Was EPC’s 2005 increase legal?
"CEO awaits AG’s response"

The Electric Power Corporation has sought legal opinion from Attorney General, Aumua Ming Leung Wai regarding the increase of electricity price in May 2005.

This came after questions raised by Newsline regarding the legality of the increase (May 2005) were directed to them last week.
Newsline obtained copies of the Electric Power Corporation (Charges for the Supply of Electrical Energy) Regulations 2007 which not only regulated the 15% increase in electricity price in February 2007, it also provide authority for the May 2005 increase.
These were approved in April of 2007.
This indicates that the increase in May 2005 was not regulated, or was done without any legal authority, until April 2007 when the Electric Power Corporation (Charges for the Supply of Electrical Energy) Regulations 2007 was approved.
EPC was contacted for a comment and they required us to put our questions in writing so that they could comment accordingly.
Our letter was delivered to the EPC office on Monday. Chief executive officer, Muaausa Joseph Walters confirmed yesterday that he has received the letter.
“We have referred it to the Attorney General’s office for a legal opinion on the issues you’ve raised,” Muaausa told Newsline.
Pressed if he himself can make a comment, he said, “all the issues regarding regulations and laws governing EPC has to be dealt with by the Attorney General’s office.”
Muaausa said he had sent a letter (with Newsline’s letter attached) to the Attorney General’s office on Monday.
“We’re hoping to hear from them (Attorney General’s office) sometime today (yesterday) or tomorrow (today),” he said.
Attorney General Aumua Ming Leung Wai’s office was also contacted yesterday.
Aumua was attending a meeting at the National Provident Fund according to the person who answered the phone.
An email was sent to Aumua seeking comments from him. It was not replied to by press time yesterday.

What does this mean?

this is very interesting which leads me to wonder if, this raise in May 2005 was illegal what does it mean? Or does this provide any basis for us the customers to sue the EPC. i really hope so, because they are really killing us with their current rates.

I was wondering if this matter can be pursued further...I mean this can make a really good story if it is pressed...just a thought...
