Assault Charges Against Police Corporal Could Be Re-filed

Attorney General Aumua Ming Leung Wai Charges of Indecent Assault and Common Assault could be re-filed against police corporal Faapaia Agafili, after the prosecution withdrew the charges from the Supreme Court this week. The door is still open to the woman victim who initially complained in 2006 about being assaulted while held in police custody on a different charge, to re-file with the court. According to Attorney General Aumua Ming Leung Wai, the victim can re-lodge her complaints. “There were 3 charges against corporal Agafili : Attempted Rape, Indecent Assault and Common Assault,” AG Aumua clarified. “Before evidence was adduced (or called) in Court, the Prosecution decided to apply to the presiding judge to withdraw the Attempted Rape charge as there was a strong possibility that the evidence would not be sufficient to prove that charge beyond a reasonable doubt. The Court responded by dismissing this charge. “The Prosecution was then ready to proceed on the remaining charges of Indecent Assault and Common Assault but when the Victim was called to testify – she did not appear. “Time was provided by the Court for the Police to locate the Victim but she was not found. “The Prosecution therefore applied to withdraw these remaining charges.
