Chief Justice Tiavasue Falefatu Sapolu yesterday questioned the mental state of a 38 year old man charged with indecent assault.
The 38 year old man prior to pleading guilty to charges of indecent assault yesterday denied the same charges.
The man from Toamua and Tanumapua was charged with indecent assault, in the Supreme Court under the ruling of Chief Justice Tiavaasue Falefatu Sapolu on Monday.
The accused reportedly went to the house of the victim on the 23rd Friday 2007 asking for food.
The mother of the victim, asked the victim an eleven year old girl from Vaitele to bring bread for the accused.
He ate the bread and afterwards he asked for more, the mother then chased the accused out of their house.
Reports state that in the early hours of the next morning Saturday 24th November, the victims mother went to a neighbors house to borrow a garden tool when the accused re entered the victims home.





 
The accused then entered the room, which the victim and a babysitter were sleeping and he then performed indecent assault on the young victim.
The victim awoke and the accused told her to shut her mouth and threatened her with a knife.
The victim was crying however the accused continued until the victims mother returned and caught him in the act, and then he ran away.
The accused had previously pleaded guilty to the charges, however on the date of sentencing he denied some of the accusations made in the report against him.
The accused stated first that he did not have a knife and that he did not touch the girl’s genitals as he was accused.
The accused is charged with one count of indecent assault.
The defendant is held in custody, and sentencing was adjourned to a later date as a proper report is still not finalized on the charges of the accused.
