A 34 year old male from the village of Toamua was ordered in the District Court last Monday to pay $250.00 or face 10 weeks imprisonment for causing actual bodily harm.
The accused was reported to have been picked up from Crabbers Nightclub in town by a taxi driver who later became a victim of his abuse on the 10th November 2007.
The accused asked the victim to drive him to Siaosi’s Restaurant at the Fugalei Market, where he bought food.
He returned and asked the victim to take him home to Toamua, upon arrival in front of the accused home he then asked the victim to come back the next day to collect the cab fare.
The victim insisted that he be paid right away, however, the accused continued to ask him to come back the next day.
The wife of the accused then came out of the house with $10.00 for the fare, the accused was angered by this.
The accused then collared and punched the victim who later reported the incident to Police.
The mitigating factors taken into account by Judge Vaepule Vaemoa Vaai were firstly that he had pleaded guilty at the earliest opportunity.
The accused was also married with children and was the main breadwinner for his family, and this was his first conviction.
The aggravating factors however, included the fact that the accused had money to buy beer for himself and food but could not pay the victims for dropping him home in his taxi.
Judge Vaepule also pointed out that people like the accused were examples of risks to people who are providing the service of public transportation.

i cant believe it..he can buy beer..but he cant pay the taxi driver...this is totally absurd...well at least he didint beat up the wife...and funny seeing the word BREADWINNER again...he should have saved up those money so he could buy food and other things for his children and wife...well i hope the taxi driver is alright.
