A male who pleaded guilty to stealing cash and an iPod from Sinalei Reef Resort will now serve three years suspended sentence after he was charged with three counts of theft and one count of breaking and entry.
The male from Siumu was reportedly under the influence of alcohol, on the day he broke into Room 6 of Sinalei Reef Resort, where a palagi couple were staying at the time.
The accused then proceeded to steal AUD$10, an iPod worth $500 and SAT $100.
According to Judge Vaepule Vaemoa Vaai the maximum sentence for theft and breaking and entry is five years imprisonment.
However Judge Vaepule accepted that this is the first conviction for the accused.
Another mitigating factor was the accused pleading guilty at the earliest opportunity and expressing remorse for his actions.
Also the accused returned everything he had stolen, AUD $10, SAT $100, and the iPod.
The Pulenuu of Siumu also wrote a letter to the Court, commenting on the services of the accused within the village.
The aggravating factors include, the fact that the accused was under the influence of alcohol and forcefully breaking and entering.
Judge Vaepule charged the accused with three years suspended sentence and warned the accused that if he is convicted again during the next three years he will be sentenced to serve jail time.
The accused was also ordered to pay $250.00, $100.00 court costs, $50.00 Police costs and $100 community costs.
